These Terms of Use (“Terms”) govern your access to and use of the website at www.sbcf.beer and related services (the “Service”), operated by SBCF (“SBCF”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Age
SBCF relates to alcoholic beverages. You must be of legal drinking age in your jurisdiction to use the Service, and you must be able to form a binding contract. You are responsible for complying with all laws applicable to you regarding the production, possession, and transport of homebrew and other alcoholic beverages.
2. Your Account
You sign in using Google. You are responsible for the activity that occurs under your account, for keeping your sign-in credentials secure, and for providing accurate, current information. Notify us promptly at info@sbcf.beer if you suspect unauthorized use of your account.
3. The Service
SBCF is a platform for organizing and participating in homebrew beer, mead, and cider competitions — including discovering and creating competitions, submitting entries, judging, volunteering, and viewing results. Features may change, and we may modify or discontinue parts of the Service at any time.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or fraudulent entry or account information
- Harass, threaten, or harm other users, judges, or organizers
- Attempt to access data you are not authorized to access, interfere with security controls, or probe, scan, or test the vulnerability of the Service
- Scrape, harvest, or use automated means to access the Service except as expressly permitted
- Undermine the integrity or fairness of judging, scoring, or competition results
- Upload malicious code or disrupt the operation of the Service
5. Competitions, Entry Fees, and Payments
Competitions are created and administered by organizers, who set their own rules, deadlines, and entry fees. Entry fees are charged through our third-party payment processor. Unless required by law or stated otherwise in a competition’s rules or the organizer’s/our refund policy, entry fees are non-refundable. You are responsible for any taxes associated with your transactions. SBCF is not responsible for the conduct of any competition or organizer, though we may remove content or competitions that violate these Terms.
6. Your Content
You retain ownership of the content you submit (such as entry details, notes, and judging feedback). You grant SBCF a non-exclusive, worldwide, royalty-free license to host, store, display, and use that content as needed to operate and provide the Service. You represent that you have the rights necessary to submit your content and that it does not violate any law or third-party right.
7. Alcohol Disclaimer
SBCF is a software platform that facilitates competition management. We do not manufacture, sell, distribute, or ship alcoholic beverages. You are solely responsible for complying with all federal, state, and local laws governing homebrewing, alcohol, and the handling and transport of competition entries. Please enjoy and handle alcohol responsibly.
8. Intellectual Property
The Service, including its software, design, and the SBCF name and logo, is owned by SBCF and protected by intellectual-property laws. BJCP-related names, marks, and style guidelines are the property of the Beer Judge Certification Program and their respective owners. You may not copy, modify, or create derivative works from the Service except as permitted by these Terms.
9. Third-Party Services
The Service relies on third parties (for example, Google for sign-in and a third-party payment processor). Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for their acts or omissions.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SBCF AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $100.
12. Indemnification
You agree to indemnify and hold harmless SBCF and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
13. Termination
We may suspend or terminate your access to the Service at any time, including for violations of these Terms. You may stop using the Service at any time and may request account deletion by contacting us. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising from these Terms or the Service, to the extent permitted by law.
